It’s been a wild ride in the financial services sector in New York since last September, when the New York State Department of Financial Services (“DFS”) first issued its sweeping draft cybersecurity regulations. After two rounds of commentary and two separate revisions, DFS has now issued its final set of rules scheduled to be in force as of March 1, 2017. Although the final rule is less prescriptive than the original draft regulations, it still carries with it a number of pitfalls and complexities of which every DFS-regulated entity should be aware.
